Earthjustice Applauds Legislation to Block Illegal National Emergency Declaration
Leading environmental law organization calls vote “a strong stand against one of the most egregious examples of executive overreach” in U.S. history

Washington, D.C. – The U.S. House of Representatives passed legislation to halt President Trump’s illegal and unconstitutional attempt to circumvent the separation of powers to build a destructive, costly border wall. The bill, sponsored by Rep. Joaquin Castro (D-TX), passed by a vote of 229-193.

The Trump Administration is attempting to flaunt bedrock constitutional and environmental laws in its pursuit of a border wall. Environmental advocates like Earthjustice – the nation’s leading environmental law organization and an active participant in the fight against border barriers since the passage of the RealID Act in 2005 – are readying legal challenges to the administration’s latest move.

The following is a statement from Martin Hayden, Vice President of Policy and Legislation, Earthjustice:

“Today, Speaker Pelosi, Representative Castro, and their colleagues in the majority reminded us why their chamber remains ‘the people’s House.’ Protecting democracy and the rule of law, these true leaders took a strong stand against one of the most egregious examples of unconstitutional executive overreach in our country’s history and they deserve our thanks for it. If the Trump Administration won’t back down from its unreasonable demands for a hateful border wall, one that would destroy communities, wildlife, and public health, they should be made to back down by Congress and courts of law.”

CREDO statement on national emergency vote in House

CREDO released the statement below following today’s U.S. House vote to revoke Trump’s national emergency declaration:

“Climate change is a national emergency, but a made-up fear-mongering campaign about the southern border definitely is not,” said Heidi Hess, co-director of CREDO Action. “Today’s vote shows that our nation is sick and tired of Donald Trump’s racist attempts to divide us, and shows his emergency declaration for what it is: an ugly attempt to grab power in service of ramping up the administration’s attacks on communities of color.”

“Senate Democrats should follow the lead of their colleagues in the House, and vote to revoke Donald Trump’s national emergency. The progressive community is watching closely, and expects Senate Democrats to present a united front in the fight against bigotry, hate, and authoritarianism. Senate Republicans, especially those in battleground states, also have an important choice to make: they can continue to be spineless lackeys for Trump or finally stand up to his threats to our democracy.”
