Background

The oil and gas industry has been pushing EPA to roll back protections under the Clean Water Act. These changes would enable operators to discharge more wastewater from drilling, fracking, and oil and gas production generally, directly into rivers and streams. Produced water management is currently a major challenge for operators in high growth oil plays like the Permian and they view the ability to simply dump their waste as a key to unfettered expansion. This study appears to be an attempt to lay to groundwork for such a rollback. In addition to comments on the study itself (which is essentially a survey of stakeholders) EPA is also soliciting feedback on potential regulatory and non-regulatory changes. On June 19, 31 organizations submitted a request for an extension to the comment period, which was denied, so the initial 45 day comment period, ending on July 1 applies.
