Thank you, @TARGET for voting against Senator Machin’s #DirtyDeal amendment. This deal is a threat to our communities, climate, and future and must continue to be kept out of all must-pass legislation, especially the upcoming budget deal.
Today, leaders like @TARGET, @TARGET, and @TARGET showed that they stand with people, not polluters. Thank you for taking a stand against Sen. Manchin’s #DirtyDeal, but we need you to continue fighting to keep this legislation off any budget deal.
Thanks to @TARGET, @TARGET, and @TARGET the #DirtyDeal has failed once again. We must continue to stand in strong opposition to this dangerous legislation and fight against its inclusion in any budget deal.

SENATE OFFCIE CALL TALKING POINTS:
- I am calling on behalf of [[Organization]] to ask Senator XXXXXX to vote “NO” on the Schumer/Manchin amendment to add Manchin’s Dirty Permitting Deal to the NDAA.
- After failing to include the amendment text in both the September CR and the base text of the NDAA due to overwhelming bipartisan opposition, Senator Manchin is threatening to bring it to the floor as a stand-alone amendment. This would endanger the NDAA process by giving one member( and no one else) the chance to alter a bill that already passed the House. We ask Senator XXXXXX to object to its consideration
- The bill was crafter behind closed doors by a handful of people without input from the majority of Congress. It has never had a hearing, committee vote or even open debate on its merits.
- It is a giveaway to the fossil fuel industry by rushing permits for dirty projects that continue to harm environmental justice communities and exacerbate our climate crisis.
- It is designed to exclude the public, particularly those communities who bear the burden of fossil fuel development (communities of color and low income) from fairly participating in the permitting process.
- Among other things, the bill would:
- Automatically approve the Mountain Valley Pipeline, overriding its permitting process and the objections from Virginia Senators and of the communities around it
- Cut the public comment period for all energy projects
- Not allow the public to challenge illegal projects in court if they cannot file their lawsuit within 150 days from the decision
- Establish unreasonably short and arbitrary deadlines for review
- Many others provisions designed to rush the permitting process, greenlight fossil fuel projects, and exclude the public
- As if that was not bad enough, the latest iteration of Manchin’s bill is even worse than previous ones.
- The revised text further tilts the scales in the favor of industry, including by creating a right of action for project sponsors to ask a court to require agencies to finalize reviews of a project within 90 days after missing one of the bill’s arbitrary deadlines
- The bill broadens the application of the permitting rollbacks to ongoing projects – adding uncertainty and new rules to impacted communities around the country.
- Weakening provisions that would speed up development of clean energy transmission
HILL BLAST:

After failing to gain support for his bill during negotiations on the base text of the NDAA, Senator Manchin has released a new version of his bill which he intends to offer as an amendment to the NDAA in the Senate this week. The most recent iteration of his legislation maintains the most problematic provisions of his previous bills while making several harmful changes including expanding the scope of projects that the bill's rollbacks would apply to, making its arbitrary and rushed deadlines enforceable in court, and further interfering with the judicial branch. This legislation would make it harder for environmental justice communities to have a say in federal decisions affecting their neighborhoods and would rush through approvals for fossil fuel projects at a time when our climate simply cannot afford them. It also reverses course from previous versions of the bill by failing to make meaningful progress on the need to quickly ramp up transmission.
The originally released Dirty Permitting Deal language was an attack on NEPA, one of the only tools that frontline communities have to influence dirty energy projects that would poison their neighborhoods. The updated language is worse, using ideas straight from the fossil fuel industry’s playbook to allow polluting industries to run roughshod over frontline communities and greenlight countless fossil fuel projects. [[Organization]] urges [[Legislator's Title+Lastname]] to oppose this newest iteration of the Dirty Permitting Deal.

I urge you to reject the “dirty permitting deal” that would do untold damage to our communities by gutting the National Environmental Policy Act. This dangerous legislation should not receive a vote, much less be attached to must-pass legislation. Its substance is dangerous, and its legislative process is an affront to open democratic process as it was crafted in back-room deals with no public knowledge of its content.
The dirty deal is nothing more than a giveaway to the fossil fuel industry that will weaken a critical environmental law that gives people a voice in federal decision-making when the fossil fuel industry decides it wants to force itself into a community to harm it. NEPA is a key tool for low-income communities and communities of color to fight back against polluting infrastructure — from pipelines to refineries to highways. Instead of falling for false industry narratives that count NEPA as a burden, look to the communities in your district and state that use NEPA as a tool to have a voice in government decisions. If you want to improve the implementation of NEPA, I urge you to follow the approach of the Inflation Reduction Act, which invested nearly $1 billion to make sure NEPA reviews are thorough and timely.
There are legislative tools to make NEPA work for communities. The Environmental Justice for All Act provides a superior alternative to the side-deal. It would create certainty for project sponsors and stakeholders by clarifying exactly how agencies should consider and address the cumulative, and often disproportionate, impacts that may result from rapid project development. This type of certainty ensures permitting and project development proceed not just efficiently, but equitably.
Communities rely on NEPA to protect their health and safety as dirty industries try to harm them. It is one of the most significant environmental laws ever passed in this country, and I strongly urge you to protect it and the communities that use it from industries that would profit from its weakening. Please oppose the “permitting side-deal” and support the Environmental Justice for All Act.

Thank you for bearing with us. Please see attached the analysis we performed on the latest iteration of Manchin’s Dirty Deal. As I have mentioned, the bill has worsen in several ways. Among the added harms is a provision that would allow industry to enforce the rushed and arbitrary deadlines in the bill by bringing a petition in court and allowing a court to compel a decision from the agency within 90 days. All of this rush is likely to result is more dirty projects approved and less time for communities to intervene in the process.
We share this analysis in good faith to ensure that all of our partners working against this bill have access to the same information. It is not for sharing with press.

What a few days! First, a huge, huge thank you to everyone for all of the amazing work, organizing, and outreach over the last few weeks (and since the summer)! This has been a long, difficult fight, but as yesterday’s news proves, our efforts are working. Senator Manchin’s dirty deal failed to get into the base text of the NDAA thanks to all of you.
However, and of course, we don’t have much time to celebrate – Senator Manchin announced his intention to get a vote on including his bill as an amendment to the NDAA next week. If that fails, there is still the threat of the appropriations package, so we aren’t quite done. We will be convening another call tomorrow morning at 10:30 am to talk next steps. Zoom link is below.
Also, please have your organizations send out thanks over social media to the following champs who were vocal in opposing the dirty deal. We really need these members to know we see their support and have their back. The list below includes the members who signed Senator Merkley’s letter as well as those members who signed Chair Grijalva’s letters who were public about their opposition the last few days.
