Background: The 2015 Clean Water Rule restored and clarified Clean Water Act protections for water bodies including headwaters, ephemeral and seasonal streams, and wetlands. These waters feed the drinking water sources for more than 117 million Americans and provide other vital benefits including flood protection, recreation, economic, and public health.

 

This rulemaking is the administration's second attempt at repealing the Rule, adding supplemental justification to the 2017 proposal that was never finalized. It will be followed later this summer or fall with a replacement "Dirty Water Rule" that will seek to narrowly define Waters of the US and limit the scope of the Clean Water Act.
